Calm Estate AB – Short-Term Rental Agreement

TERMS & CONDITIONS

For Leasing and Use of Villa Vegby and Villa Nabben (“CE”)

1. Formation of Contract

A booking is only considered legally binding once:

  • CE has issued a written booking confirmation, and

  • The required prepayment has been received in full.

Any prior communication, including inquiries, offers, or statements of intent, does not constitute a binding agreement.

2. Scope of Rental & Exclusivity

The agreement covers a fixed-term rental of the property. Upon confirmed booking, the tenant has exclusive access to the site and its facilities, except for one designated staff house, which remains excluded.

3. Booking & Capacity

The property is rented as a whole.

The maximum number of guests is limited to the agreed bed capacity.

Any increase in guest numbers requires prior written approval from CE.

4. Check-in & Check-out

  • Check-in: from 4:00 PM

  • Check-out: by 10:00 AM

Early check-in or late check-out is subject to availability and may incur additional charges.

Access details will only be provided after:

  • full payment has been received, and

  • the security deposit has been paid.

5. Payments

  • A 50% prepayment is required to secure the booking.

  • The remaining balance is due 60 days before arrival.

  • Bookings made within 60 days require full payment upfront.

Failure to meet payment deadlines entitles CE to cancel the booking.

All payments are non-refundable unless otherwise stated in these terms.

6. Cancellation by the Tenant

  • More than 4 weeks before arrival:

    Prepayments are non-refundable but may be converted into a credit valid for 3 years (minus a 5% administration fee).

  • Less than 4 weeks before arrival:

    100% of the booking amount is due.

CE will make reasonable efforts to re-rent the property. If successful, CE may reduce the cancellation cost at its discretion.

7. Cancellation by CE

CE may terminate the agreement if:

  • payment obligations are not met, or

  • the tenant breaches contractual terms in a material way.

In such cases, CE reserves the right to claim damages for financial losses.

8. Force Majeure

In case of events beyond reasonable control (e.g., natural disasters, government restrictions), both parties are released from their obligations.

Payments made may be converted into a credit for future bookings. No refunds are guaranteed.

9. Guest Policy & Events

  • Overnight stays are limited to the agreed number of guests.

  • Day visitors are permitted within reasonable limits.

Events (including weddings, celebrations, or commercial gatherings) require explicit written approval and may be subject to additional conditions and fees.

10. Use of Property

The tenant agrees to:

  • comply with all house rules

  • use the property responsibly

  • avoid disturbances to neighbors

CE reserves the right to remove guests violating these terms without refund.

11. Utilities

Utility costs are included under normal usage.

CE reserves the right to charge additional costs for excessive or unreasonable consumption, based on:

  • standard usage benchmarks

  • documented meter readings

12. Security Deposit

A security deposit of €300 is required.

The tenant remains fully liable for all damages exceeding the deposit amount.

The deposit may be used for:

  • damages

  • excessive cleaning

  • unauthorized guests

  • late check-out

Refund will be made within 7 days after inspection.

13. Condition & Handover

The property is provided in clean and functional condition.

The tenant must return the property in the same condition, except for normal wear.

Even if cleaning services are booked, the tenant must:

  • remove personal belongings

  • dispose of trash

  • clean kitchen areas

Failure may result in additional charges.

14. Liability

The tenant is fully liable for all damages caused by:

  • themselves

  • their guests

  • associated third parties

CE is liable only in cases of:

  • intent

  • gross negligence

  • personal injury

CE is not responsible for lost, stolen, or damaged personal belongings.

15. Insurance

CE maintains liability insurance.

The tenant is responsible for maintaining adequate personal liability insurance.

16. Noise & Conduct

Quiet hours apply from 10:00 PM to 7:00 AM.

Excessive noise, amplified music, or disruptive behavior is not permitted.

17. Smoking, Substances & Safety

  • Smoking is prohibited indoors

  • Illegal substances are strictly prohibited

  • Alcohol must be consumed responsibly

Violations may result in immediate termination without refund.

18. Parking

Parking is limited to designated areas (3 spaces).

Additional parking requires approval.

19. Maintenance & Emergencies

Tenants must report:

  • urgent issues immediately

  • non-urgent issues promptly

Failure to report may increase liability.

20. Data Protection

Both parties comply with applicable GDPR regulations.

21. Branding & Commercial Use

Temporary signage is allowed with prior approval and must be removed without damage.

22. No-Show

In case of no-show, the full booking amount remains payable.

23. Governing Law & Jurisdiction

This agreement is governed by Swedish law.

24. Final Provisions

This document constitutes the entire agreement.

Amendments must be made in writing.

If any provision is invalid, the remaining provisions remain unaffected.
